Terms and Conditions for Purchasing and Creating a TapTunes™ NFC Music Card

Effective Date: 01/01/2025

These Terms and Conditions govern your access, use, and orders placed at TapTunes.ai, TapTunes.com, TapTunes.us, its mobile sites, and applications (collectively, the “Site”), as well as the provision and sale of products and services by TapTunes™ Inc. By placing an order with TapTunes™; you agree to be unconditionally bound by these Terms and Conditions in the version valid at the time of ordering.

These Terms and Conditions (Agreement) govern the purchase and customization of TapTunes™ NFC Music Cards (Product) from TapTunes™, Inc. (Company). By purchasing, customizing, or using the Product, you agree to the following:

 

1. Product Description

TapTunes™ NFC Music Cards are customizable cards embedded with digital music files. Customers can upload their music.

 

2. Eligibility

  • You must be 18 or older to purchase or create a music card.

 

3. Customization Requirements

  • Customers are required to provide all necessary artwork, music files, and other customization materials in the specified formats. What is submitted is what will be printed & loaded onto your TapTunes™music card.

  • Music submissions must adhere to copyright laws. By uploading content, you confirm that you either own the rights to the music or have obtained explicit permission to use it.
     

Prohibited content includes, but is not limited to:

  • Offensive, obscene, or defamatory material.

  • Content that infringes on the intellectual property rights of others.

  • Unauthorized third-party recordings.
     

Please be aware that we are not responsible for the following: 

  1. Spelling, punctuation, or grammar errors made by the customer. 

  2. Low-quality or low-resolution images uploaded by the customer.

  3. Design errors that occur during the creation process. 

  4. Mistakes made by the user when uploading music files or artwork.

  5. Damage to products after delivery. We recommend that you carefully preview your designs and correct any errors before placing your order, as we do not proofread or edit customer-created content before processing.

 

4. Order Processing and Approval

  • Orders are subject to review for content compliance.

  • TapTunes™ reserves the right to reject any order that violates these Terms.

 

5. Pricing

  • All prices are listed in USD. Shipping is included (within the USA).

  • No refunds are allowed for TapTunes™ music cards.

  • TapTunes™ reserves the right to change its prices at any time without notice.

 

6. Delivery and Shipping

  • Delivery times are estimates and may vary based on location and production schedules.

  • TapTunes™ is not responsible for delays caused by shipping carriers, wrong address provided or unforeseen circumstances.

 

7. Copyrights/Intellectual Property

TapTunes™ requires that the Customer must be the intellectual property rights owner, lessee or license holder of all music content submitted to TapTunes™ and authorize its duplication. The Customer must also be the intellectual property rights owner, lessee or license holder of all graphic content submitted to TapTunes™, and authorize its printing.

 

The music rights customers upload remain with the Customer or the rightful owner.
 

  • By submitting music, you grant TapTunes™ a non-exclusive, royalty-free license to use the music to create the Product.

 

  1. Compliance with Intellectual Property Laws - TapTunes™, Inc. implements an Anti-Piracy Compliance Program to prevent the unauthorized distribution of content and to protect the rights of property owners. 

  2. Customer Responsibilities- By submitting materials, the Customer confirms that: - They own or have the legal rights (through licensing or other agreements) to use all intellectual property associated with the materials provided. - The materials do not infringe upon the intellectual property rights of any third party. - There are no known or pending claims or disputes regarding the ownership or use of the materials. 

  3. Indemnification - The Customer agrees to defend, indemnify, and hold TapTunes™ and its affiliates harmless from any claims, damages, or expenses (including legal fees) arising from: - Third-party claims of intellectual property infringement related to the submitted materials. - Breaches of the Customer’s warranties as outlined in this Agreement. 

  4. Company’s Rights -  TapTunes™ reserves the right to verify the ownership and legality of any materials submitted.

 

8. Disputes

  • The laws of Seminole County, FL, govern this Agreement.

 

9. Materials for Limited Use
This site contains various elements, including graphics, photographs, images, document layouts, templates, artwork, text, illustrations, logos, audio, video, music, fonts, blog posts, software tools, trademarks, service marks, and other media content owned by TapTunes™. The entire site and its content are the intellectual property of TapTunes™ or are licensed from third parties by TapTunes™. All rights to this site and its content are reserved worldwide. It is strictly prohibited to sell, license, rent, modify, retain, copy, reproduce, distribute, publish, or use any part of the content, except as expressly permitted by these TapTunes™ Terms.

 

10. Modifications to Terms

  • TapTunes™ reserves the right to update these Terms at any time. Our website will post changes, and continued service use constitutes acceptance.
